MoodWatch + Terms of Use

These Terms of Use ("Terms") are between you and Charles Miller IT Consulting, LLC ("CMIT," "we," "us," or "our"). They apply to the moodwatch.io website (the "Website"), support we provide, and your use of MoodWatch + for iPhone, iPad, Apple Watch, and Mac, including its widgets, complications, and Live Activity (the "App").

1. App license and Apple's terms

The App is licensed, not sold. Your license to use the App is governed by Apple's Licensed Application End User License Agreement (Standard EULA) and Apple's applicable App Store usage rules. The Standard EULA is incorporated here by reference for the App license. These Terms supplement the Standard EULA for the Website, purchases, support, and MoodWatch-specific features. If these Terms conflict with the Standard EULA about the App license, the Standard EULA controls.

Apple is not a party to these Terms. Nothing here changes any non-waivable consumer right you may have.

2. What MoodWatch does

MoodWatch presents a visual HeartScape based on either:

If you enable Heart Connected, the current App can compare heart-rate samples from up to the prior 48 hours with a rolling baseline and listen for new samples. The resulting states describe relative heart-rate level or movement, not emotion. Compatible sources may include Apple Watch, AirPods Pro 3 during a supported session, and other sources that write compatible readings to Apple Health. Feature availability depends on your device, operating system, hardware, permissions, connection, Apple services, and whether you have purchased the one-time History unlock.

3. Entertainment and personal reflection only

MoodWatch is an entertainment app for personal reflection. It is not a medical device, health tool, medical service, diagnostic tool, mental-health assessment, or substitute for professional judgment.

Heart rate can change for many reasons. MoodWatch's nine rhythm states describe changes in readings; they do not diagnose a condition or determine your emotion, mood, stress, intent, or mental state. Do not use MoodWatch to make medical, safety-critical, employment, insurance, or emergency decisions.

If you believe you have a medical or mental-health emergency, contact local emergency services or a qualified professional. Do not wait for, or rely on, MoodWatch.

4. Eligibility and minors

You must be legally able to accept these Terms. If you are under the age of legal majority where you live, a parent or legal guardian must approve your use and manage any required Apple Health, iCloud, and purchase permissions.

5. Permissions, devices, and your data

You are responsible for your Apple account, compatible devices, connectivity, permissions, and the accuracy of any Self Report you choose to enter. You can use Self Report without Apple Health permission.

Our handling of information is described in the MoodWatch Privacy Policy. Apple's services—including Apple Health, iCloud, CloudKit, App Store, device backups, and push notifications—are also governed by Apple's terms and your Apple settings.

6. Heart Recordings and AirPods sessions

On supported systems, the App may start a temporary HealthKit workout session to receive live heart-rate readings from AirPods Pro 3 or another compatible source. MoodWatch is designed to discard that workout session rather than save it as a fitness workout.

A Heart Recording is saved in local App storage only when you choose to save it, including when you select an End & Save behavior. The temporary HealthKit workout is still discarded. You are responsible for the recording names and content you create and for managing your device and backup settings. Do not record or use another person's health information without their knowledge and any permission required by law.

7. One-time History purchase, billing, and refunds

MoodWatch currently offers History as a one-time, non-consumable in-app purchase. It does not currently sell an auto-renewing subscription. The App Store purchase screen shows the product and price before you confirm the purchase.

Apple processes payment. You can restore the History unlock on devices using the same Apple account, subject to Apple's rules. Refund requests are handled under Apple's policies and available refund process.

We may change the purchase price prospectively as permitted by Apple and applicable law. A price change does not remove an already acquired, non-revoked History entitlement.

CMIT and its licensors retain all rights in MoodWatch, including its software, visual system, HeartScape presentation, text, graphics, trademarks, and other content, except for rights expressly granted under the Standard EULA or an applicable open-source license.

Apple, Apple Health, Apple Watch, AirPods, iPhone, iPad, Mac, iCloud, and related marks are trademarks of Apple Inc. MoodWatch is not sponsored or endorsed by Apple.

10. Feedback and support

You may send feedback or support requests to support@moodwatch.io. You grant us permission to use non-confidential feedback to improve MoodWatch without obligation to you. Do not send information you do not want included in a support email.

We aim to provide reasonable support, but we do not promise a particular response time, fix, feature, or future release.

11. Availability and changes

Apple Health readings, background updates, complications, widgets, Live Activities, CloudKit sync, Mac relay, AirPods heart-rate availability, and App Store services can be delayed, limited, or unavailable. We may add, change, suspend, or discontinue features when reasonably necessary, subject to applicable law and any rights tied to an acquired purchase.

12. Disclaimers

To the maximum extent permitted by law, the Website, support, and any MoodWatch-specific services are provided "as is" and "as available." We do not guarantee that MoodWatch will be uninterrupted, error-free, medically accurate, or compatible with every device, source, or Apple service. The warranty provisions and limitations in Apple's Standard EULA also apply to the App license.

Some jurisdictions do not allow certain disclaimers, so part of this section may not apply to you.

13. Limitation of liability

To the maximum extent permitted by law, CMIT will not be liable for indirect, incidental, special, consequential, or punitive damages; loss of data, opportunity, or profits; or harm caused by relying on MoodWatch as medical or emergency guidance. Any liability relating to the App license is also subject to the limitations in Apple's Standard EULA.

Nothing in these Terms excludes liability that cannot legally be excluded or limits non-waivable consumer rights.

14. Suspension and termination

You may stop using the Website or App at any time. Purchase and refund requests are handled through Apple. We may suspend access to CMIT-operated services if you materially violate these Terms, create a security risk, or use the services unlawfully. The Standard EULA governs termination of the App license.

Sections that by their nature should survive termination—including ownership, disclaimers, limitations, and governing law—will survive.

15. Governing law and disputes

These supplemental Terms are governed by the laws of Louisiana, United States, without regard to conflict-of-law rules, except where the law where you live provides mandatory consumer protections. Apple's Standard EULA contains separate governing-law and forum provisions for the App license.

Before filing a formal claim against CMIT, please contact us and describe the issue so we can try to resolve it informally. This does not prevent either party from seeking urgent relief or using a consumer process that cannot be waived.

16. Changes to these Terms

We may update these Terms to reflect changes to MoodWatch, Apple services, purchases, or legal requirements. We will post the revised Terms and update the date above. If a material change requires notice or consent under applicable law, we will provide it.
